Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") defines the rules for using the RightPrice service (the "Service") provided by Imum, UAB ("we", "us", "our").

By using the Service, you agree to comply with this AUP, our Terms of Service, and our Privacy Policy.

Violation of this AUP may result in immediate suspension or termination of your account without refund.

3. Permitted Use

You may use the Service to:

3.1 Legitimate Business Activities

  • Manage pricing for your own Shopify store(s)
  • Monitor competitor prices from major retailers
  • Make informed pricing decisions for your products
  • Analyze market trends and pricing data
  • Update product prices in your Shopify store

3.2 Account Management

  • Create and manage one account per subscription
  • Connect one Shopify store per subscription (or upgrade to multi-store)
  • Access features included in your subscription plan
  • Export your own data from the dashboard

3.3 Communication

  • Contact support for technical assistance
  • Provide feedback and feature requests
  • Report bugs or security vulnerabilities

4. Prohibited Use

You may NOT use the Service for any of the following:

4.1 Illegal Activities

  • ❌ Any activity that violates local, national, or international laws
  • ❌ Fraud, theft, or deception
  • ❌ Money laundering or terrorist financing
  • ❌ Violation of consumer protection laws
  • ❌ Price fixing or anti-competitive collusion with other merchants
  • ❌ Deceptive pricing practices or false advertising

4.2 Security Violations

  • ❌ Attempting to gain unauthorized access to our systems, servers, or networks
  • ❌ Hacking, penetration testing, or vulnerability scanning without written permission
  • ❌ Circumventing authentication, security, or rate limiting measures
  • ❌ Using automated tools (bots, scrapers) to access the Service
  • ❌ Reverse engineering, decompiling, or disassembling the Service
  • ❌ Attempting to access other users' accounts or data
  • ❌ Introducing malware, viruses, or malicious code
  • ❌ DDoS attacks or excessive requests that degrade service performance

4.3 Abuse of Service

  • ❌ Sharing your account credentials with unauthorized parties
  • ❌ Using one account for multiple Shopify stores (unless on multi-store plan)
  • ❌ Reselling or redistributing the Service without authorization
  • ❌ Using the Service on behalf of third parties without proper authorization
  • ❌ Exceeding rate limits (max 1000 API requests per hour)
  • ❌ Creating multiple accounts to evade billing or usage limits
  • ❌ Using the Service to compete with or replicate our business

4.4 Data Misuse

  • ❌ Scraping, copying, or storing our market data for redistribution
  • ❌ Building a competing pricing database or service using our data
  • ❌ Sharing competitor price data with third parties for commercial gain
  • ❌ Accessing or collecting personal data of other users
  • ❌ Attempting to de-anonymize aggregated or anonymized data

4.5 Intellectual Property Violations

  • ❌ Removing or obscuring copyright notices, trademarks, or proprietary marks
  • ❌ Using our brand, logo, or name without written permission
  • ❌ Copying or reproducing our documentation, UI, or content
  • ❌ Creating derivative works based on the Service

4.6 Harmful Content

  • ❌ Uploading or transmitting malicious files or code
  • ❌ Using the Service to distribute spam or phishing content
  • ❌ Harassment, threats, or abusive behavior toward our staff or other users

4.7 API Abuse

  • ❌ Making excessive API requests beyond rate limits
  • ❌ Using the API in a way that degrades service for other users
  • ❌ Caching or storing API responses beyond reasonable operational needs
  • ❌ Automated polling or scraping without proper rate limiting

5. Rate Limits and Fair Use

5.1 API Rate Limits

  • Maximum: 1000 API requests per hour per account
  • Exceeding limits: Temporary throttling (automatic retry after cooldown)
  • Persistent abuse: Account suspension or termination

5.2 Fair Use Policy

We reserve the right to determine "excessive use" that impacts service stability for other users. This includes:

  • Unusually high API request volumes
  • Large-scale automated operations without coordination
  • Storing excessive amounts of historical pricing data

6. Account Security

You are responsible for:

6.1 Your Account

  • Maintaining the confidentiality of your password and credentials
  • All activities that occur under your account
  • Immediately notifying us of any unauthorized access

6.2 Security Best Practices

  • Use a strong, unique password
  • Enable two-factor authentication (if available)
  • Do not share credentials with unauthorized parties
  • Log out after each session on shared devices

6.3 Reporting Security Issues

If you discover a security vulnerability, do not exploit it. Instead:

  1. Email us immediately at security@rightprice.app or hello@imum.io
  2. Provide details of the vulnerability
  3. Allow us reasonable time to fix it before public disclosure

We appreciate responsible disclosure and may offer recognition for valid reports.

7. Pricing and Competition Law

7.1 Your Responsibility

You are solely responsible for ensuring your pricing practices comply with applicable laws, including:

  • Competition law (anti-trust)
  • Consumer protection regulations
  • Price discrimination laws
  • Fair trading standards

7.2 Prohibited Practices

Do NOT use the Service to:

  • ❌ Coordinate prices with competitors (price fixing)
  • ❌ Engage in predatory pricing to eliminate competition
  • ❌ Mislead customers about competitor prices or comparisons
  • ❌ Discriminate unfairly between customers

7.3 Disclaimer

RightPrice provides pricing intelligence only. We do not:

  • Set or recommend specific prices
  • Advise on competition law compliance
  • Guarantee the legality of any pricing decisions

8. Shopify Integration Requirements

8.1 Authorized Access Only

  • Only connect Shopify stores you own or are authorized to manage
  • Do not connect stores belonging to others without explicit permission
  • Ensure you have the necessary permissions in Shopify

8.2 Shopify Terms Compliance

You must comply with:

  • Shopify's Terms of Service
  • Shopify's Acceptable Use Policy
  • Shopify's API Terms of Use

8.3 Pricing Updates

  • Review price changes before applying them to your store
  • You are responsible for all price updates made via the Service
  • We are not liable for pricing errors or unintended changes

9. Consequences of Violations

9.1 Warnings

For minor first-time violations, we may issue a warning with a request to stop the prohibited activity.

9.2 Suspension

For serious or repeated violations, we may immediately suspend your account:

  • Access to the Service is blocked
  • Shopify integration is disconnected
  • Subscription charges continue during suspension
  • No refund for suspension period

9.3 Termination

For severe violations, we may terminate your account permanently:

  • Immediate loss of access
  • Shopify integration disconnected
  • No refund of subscription fees
  • Data retained for 180 days, then deleted
  • Potential legal action for damages

9.4 Legal Action

We reserve the right to:

  • Report illegal activities to law enforcement
  • Cooperate with legal investigations
  • Pursue civil or criminal action for damages
  • Seek injunctive relief to prevent ongoing violations

9.5 No Liability

We are not liable for any losses or damages resulting from suspension or termination due to AUP violations.

10. Reporting Violations

10.1 How to Report

If you become aware of any violations of this AUP:

10.2 Anonymous Reports

You may report anonymously, but providing contact information helps us investigate more effectively.

10.3 Response Time

We will acknowledge reports within 2 business days and investigate promptly.

11. Modifications to This Policy

We may modify this AUP by:

  • Posting updated terms on our website
  • Notifying you via email for material changes
  • Updates take effect 30 days after notification

Continued use of the Service after changes constitutes acceptance. If you disagree, you must stop using the Service and cancel your subscription.

12. Severability

If any provision of this AUP is found unenforceable, the remaining provisions remain in full effect.

13. Governing Law

This AUP is governed by the laws of the Republic of Lithuania, without regard to conflict of law principles.
